Terms of service

The terms on which you use Insolvency Tracker, including the free checker and any paid plan.

These terms are an agreement between you and Insolvency Tracker ("we", "us", "our"). By using the website at insolvencytracker.co.uk (the "service"), or by taking out a paid plan, you agree to these terms. If you do not agree, please do not use the service.

What the service is

Insolvency Tracker brings together information about UK companies from public records and presents it in plain English. This includes a company's status, its filing history, registered charges, insolvency events, the record of its directors across their appointments, figures read from a company's filed accounts, and a list of companies currently in an insolvency process. Where a company is in an insolvency process, we also show the appointed office holder and their contact address where that is on the record.

The service reports dated facts from the public record. It does not rate, score, rank or predict, and nothing on the service is a statement that any company or person is or is not solvent, creditworthy, at risk, or likely to take any course of action.

Not advice

The service is for information only. It is not financial, credit, legal, investment or professional advice, and it is not a credit reference. Figures and facts can be out of date, incomplete or, on the underlying public record, wrong. You are responsible for any decision you make. Before acting, including before making any offer for a company or its assets, you should check the official record and take your own professional advice. The deal preparation worksheet uses figures and assumptions that you choose and control; the result is your own working estimate, not a valuation, an offer or a recommendation from us.

Your account

To use a paid plan you create an account by signing in with your email address. You are responsible for keeping access to your email secure, and for activity that happens under your account. Tell us promptly at [email protected] if you think someone else has gained access.

Plans, billing and cancellation

  • The company checker is free to use. Monitoring, which watches companies and emails you when their record changes, is a paid plan.
  • Prices are shown on the pricing page. Monthly and yearly plans renew automatically at the end of each period until you cancel. The lifetime plan is a single payment.
  • Payment is taken by our payment processor, Stripe. You provide your card details to Stripe directly; we never see or store your card number.
  • You can cancel at any time from your account. When you cancel a recurring plan you keep access until the end of the period you have already paid for, after which the account returns to the free checker.
  • Except where the law gives you a right to a refund, payments are not refundable. Nothing in these terms removes rights you have under consumer law.
  • We may change plans or prices. If we change the price of a recurring plan, we will tell you in advance and the change will apply from your next renewal, so you can cancel first if you do not accept it.

Acceptable use

You agree to use the service lawfully and not to: use it to harass, defame or make unfounded claims about any company or person; present its information as a rating, score or prediction; scrape, copy or resell the data in bulk or build a competing dataset from it; attempt to break, overload or gain unauthorised access to the service; or use it in any way that breaks the law or infringes anyone's rights. Access to the underlying public data is governed by the Open Government Licence, and you must respect that licence.

Availability

We work to keep the service available and current, but we provide it "as is" and "as available". We do not guarantee that it will be uninterrupted, error free, or that the information will be complete or accurate. We may change, suspend or withdraw any part of the service.

Our liability

Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for any loss that is not a foreseeable result of our breach, for business losses such as lost profit, revenue, data or opportunity, or for any decision you take based on the service. Where we are liable to you, our total liability in any twelve month period is limited to the amount you paid us for the service in that period, or one hundred pounds if you paid us nothing.

Changes to these terms

We may update these terms from time to time. The date at the top shows when they last changed. If a change is significant we will make reasonable efforts to tell account holders. Continuing to use the service after a change means you accept the updated terms.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, unless the law that applies where you live gives you the right to bring a claim in your local courts.
